General terms & conditions

“the W collection” is a company name, and the-w-collection.art a website from HR in Motion BV, based in Belgium and operating under Belgian law including applicable Belgian and EU consumer protection rules. References to “the W collection” hereunder also comprise HR in Motion bv.

References to “Customer” hereunder comprise a visitor of our websites or any person placing an order on them. 

Art. 1 General provisions

The e-commerce website of HR in Motion BV, with registered office at Velodroomstraat 47, 2600 Berchem, with VAT number BE0827466814 and RPR Antwerpen, (hereinafter “the W collection”) offers its Customers the opportunity to purchase the products from its online shop.

These Terms and Conditions (“Terms and Conditions”) apply to any order placed by a visitor (“Customer”) on a website by the W collection.  When placing an order through our online shop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded except when previously, in writing and expressly accepted by the W collection.

Art. 2 Price

All prices stated on our website are expressed in euros, always including VAT.  All other taxes or duties to be borne by the Customer will be explicitly mentioned or appear at checkout.

If delivery, shipping reservation or administrative costs are charged, this will be stated separately.

The listed prices do not include shipping costs. The shipping costs are always quoted when placing the order, depending on the total weight, the chosen shipping method and country of destination.

The price indication for each article refers exclusively to the articles as described in writing. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Art. 3 Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information is incomplete, contains material errors or is not up-to-date.  Obvious mistakes or errors in the offer are not binding for the W collection. the W collection is only bound by an obligation of means with regard to the accuracy and completeness of the information offered. the W collection is in no case liable in case of manifest material errors, misprints or printing errors.

If the Customer has specific questions about e.g., sizes, colour, availability, delivery time or delivery method, we request the Customer to contact us before your purchase.

The offer is valid while supplies last and may be modified or withdrawn by the W collection at any time. the W collection cannot be held liable for the unavailability of a product.  If an offer has a limited period of validity or is subject to certain conditions, this will be explicitly mentioned in the offer.

Art. 4 Placing an order online

To place an order on our website,  follow these steps:

Place your products in your cart.  The prices displayed on our website are VAT inclusive but do not include shipment costs.  Shipment costs will be shown at checkout based on your order total weight, the selected shipment method and the country of destination for your order.

Once you’ve added your products in your cart, select “go to payment”.  A new window will appear to complete your details in a secured environment. 

Did you forget something? Go to “review cart”.

Once you confirm your order and have read our terms and conditions, tick “I agree to the terms and conditions” and press the “place order” button.

Please note that you can change your mind until the last moment. If you change your mind after having accepted our terms and conditions, you can still use the right of withdrawal.  We then advise you to contact us within the hour to make sure we haven’t started processing your order.  

Once your order has been placed, we will make every effort to deliver your item(s) as soon as possible.

You will receive a confirmation e-mail for your order with a track and trace number.  With this number, you can consult any status changes regarding your order after your order has been dispatched and scanned by the carrier.

The Customer has the choice between the following payment methods:

  • Bancontact
  • Mastercard
  • Visa
  • KBC / CBC payment button
  • Belfius Pay Button

the W collection is entitled to refuse an order pursuant to a serious deficiency on the part of the Customer with regard to orders involving the Customer.

Products ordered on the W collection are delivered to addresses based anywhere in the world. 

Art. 5 Delivery and execution of the agreement

We do our best to deliver the order to you as soon as possible.

Some products might not be on stock or might encounter delays.  At checkout we try to provide you with an estimated delivery time.  We will always try to inform you as soon as possible if any changes occur or if for any reason, we cannot comply with this estimated delivery date. 

Please note that some articles may have separate delivery times.   If this is the case, it will be mentioned explicitly.

The listed prices do not include shipping costs. The shipping costs are always quoted when placing the order, depending on the total weight, the chosen shipping method and country of destination.

Delivery is made via parcel delivery from various parcel services. Therefore, we cannot guarantee the exact time of delivery.

Products ordered on the W collection are delivered WorldWide.

Any visible damage and/or qualitative defect of an article or any other shortcoming in the delivery must be reported to the W collection by the Customer without delay.

The risk of loss or damage is transferred to the Customer as soon as he/she (or a third party designated by him/her, who is not the carrier) has taken physical possession of the goods.  However, the risk already transfers to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the items and this choice was not offered by the W collection.

Art. 6 Retention property

The delivered items remain the exclusive property of the W collection until paid for in full by the Customer.

The Customer agrees to inform third parties of the W collection’s retention of property, if necessary, e.g., to anyone who may come to seize items not yet paid for in full.

Art. 7 Right of redraw / return

The provisions of this article apply only to Customers who purchase items online on the W collection in their capacity as consumers.

The Customer has the right to return the items within a period of 14 calendar days.

The return period shall expire 14 calendar days after the day on which the Customer or a third party other than the carrier and indicated by the Customer takes physical possession of the goods.

To exercise the right of return, the Customer must inform the W collection of its decision to withdraw from the agreement.

For all customers to comply with the return period, the Customer must have a written proof of the return request before the withdrawal period has expired.

The Customer must return or hand over the goods to HR in Motion BV without undue delay and in any event not later than 14 calendar days from the day on which he/she communicates his/her decision to return the item to the W collection.   The Customer is on time if he/she returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

Only returns complying with the following conditions will be accepted:

undamaged items under certain conditions:

  • A return must be made within a period of 14 calendar days
  • Labels and tags must still be attached to the ordered items as applied by us
  • The returned items must be in their original condition, with all accessories and labels attached

We will not accept returns for / The Customer cannot exercise the right of withdrawal/return for:

  • Items that do not meet the return conditions described above. For example, we do not accept return items that are not in their original condition, with all accessories and labels supplied with them, returned later than 14 calendar days

All returned items are carefully examined. The basic principle here is that the consumer may only inspect the item as he would be allowed to do in a gallery. If an article has suffered a depreciation in value due to the Customer’s use, this will be charged to the Customer.

If the Customer withdraws from the agreement (ie. requested a return), the W collection shall refund all payments received from the Customer up to that point, excluding delivery costs, to the Customer within a maximum of 21 calendar days after we have been informed of the Customer’s decision to withdraw from the agreement for orders complying with the conditions mentioned earlier in this article. the W collection may wait until it has received all the goods back, or until the Customer has proved that he/she has returned the goods, whichever comes first.

The shipping costs for returns will not be reimbursed by the W collection and are at the Customer’s charge.

the W collection will reimburse the Customer using the same means of payment with which the Customer made the original transaction, unless it has expressly been mutually agreed otherwise; in any case, the Customer will not be charged for such reimbursement.

Art. 8 Warranty

Pursuant to the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights.  This legal guarantee applies from the date of delivery to the first owner.  Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

For items purchased online and delivered to the Customer’s home, the Customer should contact the W collection and return the item to us at the Customer’s expense as per Art. 7 of this document.

Upon discovery of a defect, the Customer must inform the W collection as soon as possible.  In any case, any defect must be reported within 14 calendar days of its discovery by the Customer.  Thereafter, any right to repair or replacement expires.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Art. 10 Sanctions for non-payment

Without prejudice to the exercise of other rights available to the W collection, in case of non-payment or late payment, the W collection reserves the right to refuse the shipment of the item(s) or take back items that have not been paid for (in full).

Art. 11 Privacy

HR in Motion BV, respects the General Data Protection Regulation and the Belgian Privacy Act of 30 July 2018.

The personal data communicated by you will only be used for the following purposes: processing and sending the order, sending newsletters, advertising and/or marketing purposes.  For a full overview, please check our Privacy Policy.

You have a legal right to access and possibly correct, supplement or delete your personal data. You may also ask to restrict the processing of your personal data in a number of cases listed in the GDPR. You may also oppose the processing of your personal data if you have serious and legitimate reasons to do so that override our need to process your data.  Via a written, dated and signed request to HR in Motion BV or via werner@the-w-collection.art, you can request your personal data in digital and readable form free of charge and/or have it transferred to other controllers.  Insofar as our processing is based on your prior consent, you have the right to withdraw that consent.

In case of use of data for direct marketing: you may oppose the use of your data for direct marketing free of charge and do not have to provide a reason for doing so.

To exercise your rights, please refer to our Privacy Policy and the GDPR regulation.

We treat your data as confidential information and will not transfer, rent or sell it to third parties, except to companies cooperating with us for transporting the items to the Customer.

Art. 12 Cookies

Our website uses cookies and similar technologies. This helps us to provide you with a better user experience when you visit our website and also allows us to optimise our website. Art. 13 Impairment of validity / non-derogation

If any provision of these Terms is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by HR in Motion BV to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Art. 14 Modification of Terms & Conditions

These Terms are supplemented by other terms and conditions explicitly referred to and the general terms and conditions of sale of the W collection.  In case of contradiction, these Terms prevail.

Art. 15 Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Art. 16 Applicable laws - disputes

Belgian law applies.

The courts of the Consumer’s place of residence have jurisdiction in the event of legal disputes. The Consumer can also consult the ODR platform.
